Alan Foster


Alan has been a Law Institute of Victoria Accredited Specialist in Commercial Litigation since 1994.


With more than 30 years of legal practice, Alan ensures his clients benefit from his significant experience in complex commercial disputes, as well as from his focus on resolving commercial disputes. A particular aspect of Alan’s methodology is to team with his Co-Directors at Foster Nicholson Lawyers to develop a case strategy, where the benefit of their specialised areas of practice can be applied and considered. Alan brings a high level of personal energy to his practice.


Alan is a graduate of Monash University (B.Ec, LLB (Hons)). In 1981 he was admitted to practice in the Supreme Court of Victoria and the Federal Court of Australia. Alan has practiced exclusively in the areas of commercial law, commercial litigation, and commercial dispute resolution.

Experience and Expertise

Alan’s early years of experience include 4 years at predecessor firms to what is now known as Allens, and 10 years as a partner at Marshalls & Dent. His clients include listed public companies, high net worth individuals and their
associated entities, professional service firms, and sporting bodies. He has successfully conducted significant litigation in all the superior courts of Victoria as well as VCAT and the AAT. He has served as a chairman of the LIV Commercial Litigation Specialisation Examination Committee and as a Member of the LIV Specialisation Board.
